This Legal Notice governs the use of the ProtecTour SA mobile web application and related services (collectively, the "Service") provided by ProtecTour SA ("we," "us," or "our"), accessible at https://www.protectoursa.com/. By accessing or using the Service, you agree to be bound by the terms and conditions outlined in this Legal Notice. If you do not agree with these terms, please refrain from using the Service.   1. Use of the Service The ProtecTour SA Service is intended to provide tourists with an emergency alert system to access immediate assistance in critical situations while traveling in South Africa. The Service connects users to our 24/7 Incident Management Centre (IMC) through an emergency alert button. While we strive to ensure the availability and reliability of the Service, we do not guarantee uninterrupted access or error-free operation. The Service is provided on an "as-is" and "as-available" basis.

You agree to use the Service solely for lawful purposes and in accordance with this Legal Notice. Unauthorised use, including but not limited to tampering with the Service, attempting to access restricted areas, or using the Service to engage in illegal activities, is strictly prohibited.

  1. Emergency Services The Service facilitates communication with our Incident Management Centre, which coordinates with appropriate emergency response services as needed. ProtecTour SA is not an emergency service provider, such as police, fire, or medical services. We are not responsible for the actions, response times, or outcomes of third-party emergency services contacted through the Service. In an emergency, you are responsible for providing accurate location and situation details to ensure an effective response.

  2. Intellectual Property All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of ProtecTour SA or its licensors and are protected by South African and international copyright, trademark, and other intellectual property laws, including applicable EU intellectual property regulations. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

  3. Limitation of Liability To the fullest extent permitted by law, including Dutch law and EU regulations, ProtecTour SA, its affiliates, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or in connection with your use of the Service. This includes, but is not limited to, damages for loss of data, personal injury, or property damage resulting from reliance on the Service or the actions of third-party emergency services.

We do not guarantee the accuracy, completeness, or timeliness of the Service or any information provided through it. In no event shall our total liability to you for all damages exceed the amount paid by you, if any, for accessing the Service, per Article 6:230 of the Dutch Civil Code.

Privacy and Data Protection ProtecTour SA is committed to protecting your data in compliance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Dutch GDPR Implementation Act (Uitvoeringswet Algemene Verordening Gegevensbescherming).   1. Consumer Rights (Netherlands and EU) If you are a consumer residing in the Netherlands or another EU Member State, you may have additional rights under EU consumer protection laws, including Directive (EU) 2011/83 on consumer rights. If the Service is purchased as a digital service, you may have a 14-day right of withdrawal, unless the Service has been fully performed with your express consent before the withdrawal period expires. Termination We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates this Legal Notice or is harmful to other users, third parties, or our business interests. Governing Law and Dispute Resolution This Legal Notice shall be governed by and construed per the laws of the Republic of South Africa, except where EU or Dutch law applies to specific consumer or data protection rights. For users in the Netherlands, any disputes arising from or related to the Service may be submitted to the competent courts of the Netherlands, per Dutch law.
